A. It shall be unlawful for a mobilehome park owner to demand any rent in excess of the increase permitted in accordance with Section 6.50.040(A) during the period from the filing of a timely petition to the date an arbitrator’s decision approving such excess is rendered.

B. It shall be unlawful for a mobilehome park owner to demand, accept, receive or retain any rent in excess of the maximum rent allowed by the decision of an arbitrator in accordance with this chapter.

C. It shall be unlawful for a mobilehome park owner to demand, accept, receive, or retain any rent in excess of the maximum rent allowed in accordance with applicable provisions of this chapter.

D. In the event an affected tenant paid rent in excess of that permitted by this chapter, the mobilehome park owner shall reimburse the affected tenant the entire amount of overpayment in one lump sum payment, which must be paid by the time the affected tenant’s next monthly rent obligation is due.

E. Any violation of the requirements of this section is unlawful and subject to the remedies in Section 6.50.200.
