A. A person or business that generates hazardous waste shall complete a Hazardous Materials Business Plan and CUPA permit application. The business shall be subject to the requirements of Health and Safety Code Section 25100, et seq. and California Code of Regulations, Title 22, Division 4.5.

B. A business that is regulated under the permit-by-rule, conditional authorized or conditional exempt tier of Health and Safety Code Section 25100, et seq. shall be required to complete a CUPA permit application as well as DTSC form 1772 or other approved form. The business shall be subject to the requirements of Health and Safety Code Section 25100, et seq. and California Code of Regulations, Title 22. Division 4.5.
