A. The federal Clean Water Act provides for the regulation and reduction of pollutants discharged into the waters of the United States by extending national pollutant discharge elimination system requirements to stormwater and urban runoff discharge into the city’s municipal separate storm sewer system (MS4).

B. The city’s stormwater management plan requires the city to effectively prohibit nonstormwater discharges from the incorporated area of the city into the city’s MS4 except as otherwise permitted by law.

C. The council finds in this regard that the provisions of this chapter are necessary to provide the city with the legal authority necessary to implement the Stormwater Management Plan.
