Any applicant may appeal any decision or determination of the superintendent of streets to the city council. Such appeal shall be made in writing not later than ten days from the date of such decision or determination shall be filed with the city clerk. The city clerk shall set a date for hearing at a regular or special meeting of the city council not more than thirty days from the date of the filing of the appeal. The hearing before the city council shall be informal and technical rules of evidence shall not apply. At the conclusion of such hearing the city council shall affirm, modify and affirm, or revise the determination or decision of the superintendent of streets. The decision of the city council shall be final and binding on all parties and shall be adopted by resolution. (Ord. 1209 NCS §3 (part), 1976.)
